Senior Legal Counsel Of Marketing And Brand, Director Full-time

Job Title: Senior Legal Counsel of Marketing and Brand, Director

The purpose of this Senior Legal Counsel -Director, Marketing and Brand, is to provide legal support and coordinate with other internal functions to ensure the marketing of the business aligns to and is in compliance with all applicable laws, rules and regulations; and to manage our intellectual property portfolio. You'll collaborate with key business stakeholders from ideation to realization on consumer and dealer-facing promotional and creative marketing materials, customer engagement initiatives, and assist in developing Company strategy related to brand awareness, marketing, and customer engagement. We guide the company to protect and leverage the innovations that create the experiences and the brand to which they attach. This role is an integral part of that effort.

Duties:
  • This position will be remote. Occasional planned travel to an assigned travel to the office location may be required
  • Counsel and advise on marketing and promotional initiatives (email, blog posts, consumer surveys, presentations) including review of advertising across all marketing channels to ensure materials are legally and company compliant.
  • Educate and train the organization on legal aspects of marketing, advertising, content & social media.
  • Manage the Company's IP portfolios (including trademarks, patents, copyrights, and trade secrets).
  • Provide intellectual property counseling on risks associated with advertising campaigns, including drafting and negotiating copyright, trademark, right of publicity licenses or rights acquisition and other talent and production-related agreements.
  • Coordinating directly and efficiently with colleagues from the Company's Product Management, Brand Management, and Marketing teams; and seek alignment across those cross functional teams.
  • Ensure compliance with trademark, copyright, consumer protection, and advertising laws.
  • Provide data and privacy-related advice in connection with consumer research, emails, websites, promotions, marketing campaigns and activations.
  • Structure, draft and negotiate a wide variety of agreements, especially those relating to marketing and advertising, sponsorship opportunities, social media and brand management
  • Provide strategic advice to clients on building and managing a brand program.
  • Enabling the business to timely achieve its targets, while respecting the Company's principles and applicable laws, and assisting in embedding these principles into the Company's processes and decisions.
  • Perform marketing and advertising legal research and risk assessments.

  • A broad legal knowledge that enables you to spot and resolve a variety of legal issues in upcoming product offerings (e.g., regulatory, contract, IP, privacy, consumer protection, risk); and an ability to distill complexity and to identify and clearly communicate practical, risk-based solutions
Requirements:
  • Licensed as an Attorney to practice law, with a minimum of 7 years as a practicing Lawyer providing counsel to businesses on advertising and promotional laws and regulations
  • Experience reviewing and advising on advertising, marketing, promotions, copyright, right of publicity, trademark, production and related agreements
  • Knowledge of privacy, data protection and consumer protection requirements
  • Exhibits solid judgment, integrity, communications, and interpersonal skills
  • Proactive, collaborative, diligent, flexible, and strives for operational excellence
  • Experience working in a fast-paced environment in web, app, social networking, internet, or technology companies
  • Experience working cross-functionally with multiple stakeholder groups
